The special counsel team led by Cho Eun-seok seeks to detain former National Intelligence Service(NIS) Director Cho Tae-yong on charges of aiding the December 3 martial law declaration.
The team announced on Friday that it had requested the pretrial detention of Cho Tae-yong, who is accused of violating the National Intelligence Service Act, dereliction of duty, perjury and destroying evidence.
Prosecutors say Cho Tae-yong knew about former President Yoon Suk Yeol's plan to declare martial law before it was announced, but failed to report it to the National Assembly.
The Seoul Central District Court said it will hold a warrant hearing on Tuesday at 10:10 a.m.
The special counsel team also suspects that Cho Tae-yong breached his obligation to maintain political neutrality by providing CCTV footage to People Power Party lawmakers that depicted former NIS Deputy Director Hong Jang-won.
It additionally believes that Cho Tae-yong falsely testified that he'd never received any martial law-related instructions.
The special counsel team’s attempt to detain Cho comes three days after he was questioned as a suspect in the martial law case.
